Passenger Transport Agreement

1 - Parties

This Passenger Transport and Service Agreement (the "Agreement") is made between Seaside VIP (hereinafter referred to as "Seaside Vip") operating at Altıntaş Mah. 31111 sok. No:3 Aksu-Antalya, and the passengers who make a reservation via https://seasidevip.com and/or on whose behalf a reservation is made (hereinafter referred to as the "Passenger").

Unless otherwise stated in this Agreement, "Seaside Vip" and the Passenger shall be individually referred to as "Party" and collectively as "Parties".

2 - Subject

With this Agreement, the Parties agree, within the framework of the following Agreement conditions, on the provision of the purchased transfer service for airport transfers within the borders of Turkey, before and after the flight, in the directions of airport-address or address-airport, with designated vehicles, and the collection of the service fee by "Seaside Vip" in return for this service.

3 - Service and Payment Details

  1. 3.1. The Agreement fee is specified in the service details, including VAT.
  2. 3.2. I accept that Seaside Vip is authorized to collect all fees for the transfer service I have purchased and/or will purchase through this Agreement using the credit card I enter on the PARATIKA screen, and I authorize Seaside Vip to make this credit card withdrawal.
  3. 3.3. The invoice issuance period for the purchased service is 7 days, including the date of purchase, as required by V.U.K., provided that it does not cross into a new month.

4 - General Provisions

4.1 The Passenger is obliged to act in compliance with all regulations, especially the Highway Traffic Law, and must follow all rules within the legal framework, such as wearing a seat belt and adhering to safety rules inside the vehicle.

4.2 If the Passenger has purchased the transfer service with a credit card or debit card, they are deemed to have accepted the written terms of the service agreement, even if they have not signed the user service agreement.

4.3 To benefit from the transfer service subject to this Agreement, the Passenger must have made a reservation at least 2 hours before the transfer time. On religious and national holidays, New Year's, and other public holidays, a reservation must be made at least 24 hours before the transfer time. The reservation can be canceled by the Passenger up to 24 hours before the transfer time. In this case, the service fee paid by the Passenger will be refunded. No refund will be made for cancellations made outside of the specified periods.

4.4 The Passenger has no authority to change the route for all travel services. Requests for the Passenger to stop at a different location or to wait for a period at that location are not accepted. In Seaside Vip's transfer service, different destination requests other than the route(s) specified in the agreement will be charged for each different location.

4.5 Seaside Vip is obliged to allocate a vehicle suitable for the number of passengers and luggage volume specified by the passenger during the purchase of the transfer service, with all assessment authority belonging to Seaside Vip. Seaside Vip accepts and undertakes that all vehicles to be allocated to the service subject to this Agreement will have comprehensive personal accident and seat insurance, that periodic maintenance of the vehicles will be carried out within the specified periods, and that mandatory equipment such as a spare tire, first aid kit, fire extinguisher, and reflector will be present in the vehicle. In the event of a traffic accident or any other reason during the transfer, causing physical or material damage to the customer or damage to the transported goods, Seaside Vip shall not be responsible for these damages. The customer irrevocably accepts and declares in advance that Seaside Vip has no responsibility arising from Article 66 of the Code of Obligations and other provisions of the legislation.

4.6 Apart from Seaside Vip's acceptance of the passenger and luggage information declared by the passenger at the time of purchase, passengers or luggage exceeding the accepted limits cannot be accepted into the vehicle. If the Passenger cancels the transfer service for this reason, no refund can be made.

4.7 If necessary, the passenger is obliged to prove that they are the customer who purchased the service to the vehicle personnel with legally issued identity documents and the reservation voucher. The transfer of a customer who fails to fulfill this obligation will not be carried out. However, if Seaside Vip concludes that the credit card holder who made the reservation has consented to the Passenger receiving this service, the Passenger may be allowed to use the service.

4.8 Seaside Vip is not responsible for the loss or damage of any items forgotten by the customer in the vehicle during the transfer. In such a case, the Passenger should contact the Seaside Vip call center and collect the forgotten item from the address provided to them once it is found.

4.9 Seaside Vip transfer vehicles do not accept sacks, crates, boxes, etc. as luggage. The Passenger is entitled to a maximum of 1 hand luggage and 1 suitcase per person (Hand luggage must not exceed 8 kg, and the passenger's suitcase must not exceed 32 kg). The Passenger accepts, undertakes, and declares that the luggage subject to transfer does not contain any flammable, explosive, narcotic, liquid, odorous, radioactive, or any other substance prohibited from being transported and held by Turkish law. If the presence of such substances in the luggage is noticed by the driver, the said luggage will not be accepted into the vehicle. Furthermore, in such cases, the passenger cannot claim any receivable or right against Seaside Vip under any name. If the presence of the substances mentioned above is noticed in the luggage, the situation will be immediately reported by Seaside Vip to the relevant official authorities. If the presence of the mentioned substances is not noticed by the driver but is detected when the vehicle is stopped and searched by law enforcement during the transfer, any and all damages and losses incurred by Seaside Vip and/or any person for this reason will be immediately and fully compensated by the passenger.

4.10 Pet transfers in our vehicles are carried out in a secure cage, provided that they do not disturb other passengers and with prior notice given during the reservation. Only cats, dogs, and small singing birds are transported as pets. Cage dimensions must be a maximum of 23*40*55.

4.11 Passenger information

4.11.1 The reservation information or pre-information for the service purchased by the Passenger will be shared via e-mail and/or SMS. The Passenger is responsible for the accuracy of the phone number and e-mail address provided. Seaside Vip cannot be held responsible for the failure of these communications to reach the Passenger due to incorrect contact information.

4.11.2 In shared transfers, an estimated pick-up time will be shared with the passenger via e-mail and/or SMS 12 hours before the transfer. In VIP service, the service will be provided according to the pick-up and drop-off times specified by the passenger.

4.12 For transfers from a specific location to the airport; Seaside Vip declares and undertakes that the vehicle allocated for the transfer will be at the designated location at the transfer time. The Passenger is notified via e-mail and SMS before the specified transfer date and time. A delay of up to 20 (twenty) minutes from the transfer time notified to the Passenger will be considered a reasonable delay, except for extraordinary circumstances, unforeseen events, force majeure, floods, hail, rain, traffic congestion, etc. In transfer points such as gated communities or housing estates, Seaside Vip is not responsible if the 20 (twenty) minute delay is exceeded due to the security guards preventing the vehicle from entering the site. If the 20 (twenty) minutes are exceeded in this way and the Passenger does not wait for the vehicle, no refund will be made. The Passenger must be ready at the designated location with their luggage at the transfer time. If the Passenger is not ready at the transfer point at the transfer time, the vehicle allocated to Seaside Vip is obligated to wait for the passenger for 5 (five) minutes. At the end of 5 (five) minutes, if the Passenger has not arrived at the designated location with their luggage, the vehicle has no further obligation to wait. The time notifications of Seaside Vip's operations, call center, and drivers will be binding for the parties.

4.13 In case of delays or waiting for more than 2 (two) hours for any reason, Seaside Vip's obligation to wait for the vehicle at the airport ceases. In shared transfers, the transfer will be carried out by Seaside Vip according to the appropriate time and vehicle availability. In VIP service, a suitable vehicle will be allocated by Seaside Vip and the service will be provided.

4.14 Agreements with contracted companies and campaign conditions will apply. Seaside Vip is obliged to ensure that the vehicles arrive at the service locations at the time promised to the Passenger. If the vehicle in question cannot go to the approved job due to a problem originating from Seaside Vip, the service will be provided with a second vehicle without any additional charge to the Passenger. If the second vehicle also fails to reach the Passenger's address on time or if the Passenger cannot get to their flight on time with the second vehicle, all alternative transportation costs necessary for the Passenger to get to the airport will be the responsibility of Seaside Vip. In cases where the Passenger is forced to use another means of transportation (e.g., commercial taxi, public transport, their own vehicle), the service will be provided again free of charge at a time requested by the Passenger, or the amount paid for the service (with documentation) will be refunded to their credit card without any deductions. In the event that the customer misses their flight due to a defective service, Seaside Vip will only cover the transfer damage that will arise from the Passenger's airport transfer. This damage will in no way and under no circumstances exceed 400 (four hundred) TL.

4.15 The vehicle driver at the transfer point is not obligated to leave the vehicle and accompany the passenger to their side, to the vehicle, or to their home.

4.16 The transfer of children under the age of 18 will not be carried out without an accompanying adult or the consent of their family.

4.17 If a wheelchair transfer is also requested along with the passenger in shared transfers, this must be specified by the Passenger at the time of reservation. Otherwise, the Passenger will be responsible for any and all damages that have arisen and/or will arise due to reasons such as any delay and/or the Passenger not being able to board the vehicle, and Seaside Vip will have no responsibility. Physically disabled Passengers who are able to meet their personal needs can travel alone without a companion. However, Passengers who are unable to meet their personal needs can be transferred with a companion. The necessary reservation and payment for this companion must also be made.

4.18 When purchasing an online ticket with a credit card that does not belong to Turkish banks, your bank may charge an additional transaction fee to your ticket price. For detailed information, the Passenger must contact their bank.

4.19 Patient Passengers who do not have a contagious disease and have no medical contraindication for travel are accepted for transfer with a doctor's report containing the phrase "no contraindication to travel" prepared no more than 20 days before the transfer.

5 - Cancellation – Refund Conditions

5.12 This Agreement shall be governed by Turkish Law. In the event of any dispute arising between the Parties to this Agreement regarding its interpretation and implementation, the Istanbul Courts and Enforcement Offices shall have jurisdiction.
